Please read these Terms of Service (“Terms”) carefully before using willowandbirch.org (the “Site”) operated by Willow & Birch, LLC (“Willow & Birch,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms.

1. About Willow & Birch

Willow & Birch is a senior care advocacy and concierge hub. We help Southern California families navigate senior care decisions by providing information, resources, and introductions to independent care providers. We are a connector and guide — not a licensed care provider, medical practice, law firm, or financial advisory firm.

2. Not Professional Advice

Nothing on this Site constitutes medical, legal, financial, or therapeutic advice. All content is provided for informational purposes only. The Family Care Checklist, provider listings, and any other resources on the Site are educational tools and starting points for your own research and conversations with qualified professionals.

You should always consult a licensed physician, attorney, financial advisor, or other qualified professional before making decisions about care, legal documents, financial accounts, or end-of-life planning.

3. Provider Listings & Introductions

Care providers listed on the Site are independent businesses and individuals. Willow & Birch curates listings based on our own research and relationships, but we do not employ, supervise, or guarantee the services, credentials, licensure, or conduct of any listed provider.

When you request an introduction to a provider, we facilitate the connection by email. Any subsequent agreement, engagement, or service relationship is solely between you and the provider. Willow & Birch is not a party to that relationship and bears no responsibility for outcomes.

4. Family Care Checklist

The checklist tool is a private, browser-based resource. Your responses are never transmitted to us and remain entirely on your device. Any PDF you generate is created locally and is not shared with Willow & Birch. We do not store, access, or have any visibility into your checklist answers.

5. Intellectual Property

All content on this Site — including text, design, graphics, the Willow & Birch name and logo, the checklist structure, and all written copy — is the property of Willow & Birch, LLC and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works from Site content without our written permission.

6. User Conduct

You agree not to:

• Use the Site for any unlawful purpose
• Submit false, misleading, or fraudulent information through any form
• Attempt to gain unauthorized access to any portion of the Site or its infrastructure
• Scrape, copy, or reproduce Site content for commercial purposes without written permission

7. Disclaimer of Warranties

The Site and all content are provided “as is” without warranty of any kind, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or that provider listings are complete or current. We make no representations regarding the accuracy or suitability of any provider listed on the Site.

8. Indemnification

You agree to indemnify, defend, and hold harmless Willow & Birch, LLC and its members, officers, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site or its content; (b) your submission of any information through the Site; (c) any service relationship or dispute between you and a care provider introduced through the Site; or (d) your violation of these Terms or any applicable law.

9. Limitation of Liability

To the fullest extent permitted by law, Willow & Birch, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, reliance on any content, or any service relationship with a listed provider. Our total liability for any claim arising from these Terms shall not exceed $100.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Los Angeles County, California.

11. Changes to These Terms

We may update these Terms from time to time. The “Last Reviewed” date at the top of this page will reflect any changes. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
